1. Definitions
In these Terms and Conditions:
- "Firm," "we," "us," "our" refers to Pelangi Adil, a legal practice operating from No. 19, Lebuh Pantai, 10300 Georgetown, Penang, Malaysia.
- "Service" refers to the legal services offered by the Firm, including the Listening Session for Couples in Difficulty, the Application for Domestic Protection Order, and the Long-Term Co-Parenting Framework.
- "Client," "you," "your" refers to the individual who engages the Firm's services or uses the Firm's website.
- "Website" refers to the Firm's website at https://pelangiad.
- "Agreement" refers to the written client engagement letter signed between the Firm and a Client, incorporating these Terms and Conditions.
2. Acceptance of Terms
By using the Website or engaging the Firm's services, you confirm that you are at least eighteen (18) years of age and have the legal capacity to enter into a binding agreement under Malaysian law.
Your continued use of the Website constitutes acceptance of these Terms and Conditions. For formal legal engagements, acceptance is formalised through a signed client engagement letter.
3. Description of Services
The Firm provides civil family law services in Malaysia, specifically:
- Listening Session for Couples in Difficulty — A single fixed-fee advisory session (RM 320) for couples uncertain about legal steps.
- Application for Domestic Protection Order — Legal representation in applications under the Domestic Violence Act 1994 (RM 720).
- Long-Term Co-Parenting Framework — A multi-session engagement to produce a written co-parenting arrangement (RM 980).
All services are subject to the Firm's professional obligations under the Legal Profession Act 1976 and the Malaysian Bar's Professional Conduct Rules and Etiquette. The Firm reserves the right to decline or discontinue a matter where professional obligations require it.
Services are available to clients in Peninsular Malaysia. The Firm does not advise on Syariah law matters; where Syariah jurisdiction applies, clients will be informed and, where appropriate, referred to a suitable practitioner.
4. Client Engagement and Fee Agreements
No legal engagement is formed until both parties have signed a written client engagement letter. The Website's contact form constitutes an enquiry only and does not create a legal relationship or obligation on either party.
The fees stated on the Website are indicative. The fees applicable to your matter will be confirmed in writing before any engagement is formalised. The Firm will not commence billable work without your written confirmation.
5. Payment Terms
Fees are payable in Malaysian Ringgit (RM). Payment methods and timing will be specified in the client engagement letter. For fixed-fee services, payment is typically required prior to or at the session. For multi-session engagements, a payment schedule will be agreed in advance.
Invoices are payable within fourteen (14) days of issue unless otherwise agreed in writing. Late payment may result in suspension of services.
5.1 Refunds
Where a session has not yet taken place, a written request to cancel received at least forty-eight (48) hours in advance will result in a full refund of any payment received. Cancellations with less than forty-eight hours' notice may be subject to a cancellation fee of fifty percent (50%) of the session fee. Work already completed on multi-session engagements is not refundable.
6. User Responsibilities
You agree to:
- Provide accurate and complete information when making an enquiry or engaging services
- Cooperate with the Firm's reasonable requests for information necessary to conduct your matter
- Not use the Website for any unlawful or inappropriate purpose
- Not attempt to interfere with the Website's operation or security
7. Intellectual Property
All content on the Website — including text, layout, and design — is the property of Pelangi Adil or its licensors and is protected under Malaysian intellectual property law. You may view and print Website content for personal, non-commercial use only. Reproduction or redistribution for any other purpose requires the Firm's written consent.
Documents produced for you in the course of a legal engagement remain the property of the Firm until all fees have been paid in full.
8. Confidentiality
The Firm is bound by strict professional duties of confidentiality under Malaysian Bar rules and the Legal Profession Act 1976. Information you share with the Firm in the course of an engagement will not be disclosed without your consent, except where required by law or court order.
9. Disclaimers
The information on the Website is provided for general informational purposes only and does not constitute legal advice. No legal relationship is created by use of the Website. Outcomes in legal matters depend on individual circumstances and cannot be predicted or guaranteed.
The Firm makes no representations about the suitability of the Website's content for any particular purpose and provides it on an "as is" basis.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law, the Firm's liability in connection with its services is limited to the fee paid for the specific service in question. The Firm is not liable for indirect, consequential, or incidental loss arising from your use of the Website or from any legal engagement, except where liability cannot be limited by law.
11. Termination
Either party may terminate a legal engagement by written notice. The Firm may terminate an engagement where professional obligations require it to do so, including where continued representation would put the Firm in breach of its duties. In such circumstances, the Firm will take reasonable steps to minimise disruption to your matter.
On termination, all outstanding fees for work completed become immediately due.
12. Dispute Resolution
We encourage any client concerns to be raised with us directly in the first instance. We will attempt to resolve disputes informally and in good faith.
If a matter cannot be resolved informally, complaints may be referred to the Malaysian Bar's Disciplinary Board. These Terms and Conditions are governed by the laws of Malaysia, and any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia sitting in Penang.
13. General Provisions
These Terms and Conditions, together with any signed client engagement letter, constitute the entire agreement between the Firm and the Client in relation to the matter they govern. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
The Firm's failure to enforce any provision does not constitute a waiver of its right to do so at a later time. These Terms may not be assigned without the Firm's written consent.
14. Changes to These Terms
We may update these Terms and Conditions from time to time. Changes will be published on the Website with a revised effective date. Continued use of the Website after any change constitutes acceptance of the updated Terms. Changes to the terms of an ongoing engagement require a signed variation to the client engagement letter.
